How to sell a house as-is in Rhode Island without repairs

"As-is" gets used loosely. In practice it means you are not making repairs, not issuing credits, and not chasing an inspection list — but you still have paperwork obligations, and the town still wants its money at closing. Here is how the pieces fit together on a Rhode Island sale.

As-is does not mean you skip disclosure

Rhode Island requires sellers of residential real estate to give buyers a written disclosure of known material defects on the state's Real Estate Sales Disclosure form, and there are separate lead paint obligations for housing built before 1978. Selling as-is changes who fixes the problem — it does not let you hide one you know about.

That is usually good news for sellers. Writing down "the roof leaks over the back bedroom" and "the boiler is original" is far easier than negotiating those items after an inspection with a financed buyer.

What the municipality collects at closing

Before a Rhode Island closing funds, the closing attorney orders payoff and municipal lien certificates. Expect these to be settled out of the sale proceeds rather than out of your pocket:

  • Mortgage and home equity line payoffs
  • Delinquent property taxes and any tax sale redemption amount
  • Water and sewer balances (in Providence and many RI towns these attach to the property)
  • Recorded contractor's or attorney's liens, and probate-related encumbrances

Listing as-is vs. selling to a cash buyer

You can list an as-is house on the MLS. It works when the property is financeable — meaning a lender's appraiser will not flag missing handrails, active leaks, an unpermitted third unit, or a failed septic. When it is not financeable, the buyer pool narrows to cash, and you end up negotiating with the same type of buyer you could have gone to on day one, only months later and after carrying costs.

The practical test: would a conventional or FHA appraiser sign off on this house today? If the answer is no, price and timeline are better served by a direct cash sale.
